TERMS OF USE

AGREEMENT

By checking the box next to this Terms of Use and clicking the “Purchase” button, this Agreement (the “Agreement”) is entered into by and between Petra Rising LLC DBA We Are The Women (“We Are The Women”), a Texas corporation, and (“Client”) (collectively the “Parties” and individually “Party”). Client also waives certain legal rights including the right to sue Petra Rising DBA We Are The Women or to claim compensation following an accident.


Petra Rising, LLC, DBA We Are The Women (a Texas Limited Liability Company) is hosting a personal and professional development retreat, including group coaching sessions, workshops, outdoor activities, group dinners, excursions, and other physical and wellness-related experiences (collectively the “Activities” or individually an “Activity”) from 10/1/2026 through 10/4/2026 at Lost Pines Resort & Spa 575 Hyatt Lost Pines Road Lost Pines, Texas, 78612 (the “Property”).

RELEASE OF LIABILITY, ASSUMPTION OF RIST AND INDEMNITY AGREEMENT

In consideration of being allowed to participate in the Retreat and various Activities made
available during that time, I enter into this Release Agreement as follows:

1. I hereby acknowledge that physical activities including, but not limited to, yoga, surfing, snorkeling, boating, hiking, beach games, sporting activities, dancing, travel (whether by air, land or sea) and exercise, among all other Activities, are POTENTIALLY DANGEROUS ACTIVITIES that involve the risk of SERIOUS INJURY, DEATH, FINANCIAL LOSS and/or PROPERTY DAMAGE, whether such risks are foreseen or unforeseen.

2. I further acknowledge, represent, warrant, and agree that I will be responsible for my own safety and welfare during each Activity, as well as after and before the Retreat, whether on or off the Property. I AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH THAT MAY OCCUR, whether associated with my general
attendance of the Retreat, any Activity, or otherwise.

a.

I represent that I am physically and mentally fit to participate in the Retreat and all associated Activities. I agree to assume full responsibility for consulting with a medical professional prior to attending if I have any conditions that could be affected by physical, emotional, or environmental stressors. I further understand that Petra Rising LLC DBA We Are The Women is not responsible for assessing my physical condition or medical needs.

b.

In the event of a medical emergency, I hereby authorize the Released Parties to secure medical treatment on my behalf if I am incapacitated or otherwise unable to consent. I understand I am solely responsible for the costs of such care.

3. I hereby RELEASE, WAIVE, DISCHARGE, and AGREE TO HOLD HARMLESS Petra Rising LLC DBA We Are The Women, its employees, officers, agents, assigns, owners, attorneys, or insurers (the “Released Parties”) from ANY AND ALL LIABILITY OR RESPONSIBILITY WHATSOEVER TO MYSELF, my personal representatives, assigns, heirs, or next of kin, for property damage, personal injury, including death, that I may suffer as a result of my participation in any Activity or my attendance of the Retreat, however caused, EVEN IF CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES, whether passive or active.

4. I further acknowledge, represent, warrant and agree to forever WAIVE and GIVE UP ANY RIGHT FOR MYSELF, my personal representatives, assigns, heirs, or next of kin, TO COLLECT monetary damages, including costs and attorneys’ fees, from any of the Released Parties for property damage, breach of contract or warranty, personal injury or wrongful death, or any other cause of action or theory of recovery, that may occur as a result of my participation in any Activity or my attendance of the Retreat, however caused, even if caused by the negligence of the Released Parties, whether passive or active.

5. I knowingly and voluntarily waive any and all rights I may have under any state law, that provides, as follows in substance: A general release does not extend to claims which the creditor does not know or suspect to exist in the creditor’s favor at the time of executing the release, which if known by the creditor must have materially affected the creditor’s settlement with the debtor.

a.

I acknowledge that participation in a group event may expose me to contagious illnesses, including but not limited to COVID-19 or other viral or bacterial infections. I voluntarily assume the risk of exposure and agree to hold the Released Parties harmless for any illness contracted during or following the Retreat.

6. I further acknowledge, represent, warrant and agree that any INJURIES RECEIVED as a result of my participation in an Activity or my attendance of the Retreat, however caused, 7. 8. MAY BE COMPOUNDED, AGGRAVATED, OR OTHERWISE INCREASED BY RESCUE PROCEDURES, negligent or otherwise, attempted or carried out by the Released Parties, and agree that this Release Agreement extends to all acts of negligence by the Released Parties, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to
be as broad and inclusive as permitted by the laws of the state of Texas in the United States of America.

a.

I understand that no formal refund or cancellation policy was presented at the time of purchase. I acknowledge that my participation in the Retreat is voluntary and that Petra Rising LLC DBA We Are The Women is under no obligation to provide refunds or rescheduling opportunities for any reason, including illness, travel disruption, or inability to attend. Any exceptions or accommodations are at
the sole discretion of the company.

b.

I understand that alcohol and/or other legal substances may be available during the Retreat. If I choose to consume them, I do so voluntarily and at my own risk. I accept full responsibility for my actions, conduct, and any consequences arising from consumption, and I hold the Released Parties harmless for any related injury, accident, or incident.

7. I understand and agree that if any part of this document is determined to be unenforceable, all other parts shall continue to be given their full effect. I agree that any dispute regarding this Release Agreement shall be governed by and interpreted in all respects in accordance with the laws of the United States of America and the State of Texas. The venue for any dispute shall be in the County of Hays.

8. I have carefully read this Release Agreement and fully understand its contents. In entering into this Release Agreement, I am not relying upon any oral or written representations made by the Released Parties other than what is set forth in this Release Agreement. I AM AWARE THAT THIS RELEASE SERVES TO WAIVE ANY LIABILITY ON THE PART OF PETRA RISING LLC AND SIGN IT KNOWINGLY, VOLUNTARILY, AND OF MY OWN FREE WILL.

PHOTO/VIDEO RELEASE

In consideration of being allowed to attend the Retreat, organized and hosted by Petra Rising LLC DBA We Are The Women from 10/1/2026 through 10/4/2026 at Lost Pines Resort & Spa 575 Hyatt Lost Pines Road Lost Pines, Texas, 78612 (the “Property”), I enter into this Photographic Release Agreement as follows:

1. I hereby irrevocably and permanently grant, assign and convey to Petra Rising LLC DBA We Are The Women, its employees, officers, agents, assigns, owners, attorneys, or insurers (the “Released Parties”) the right to use, broadcast, distribute, and exhibit in any form now or later developed, including publications for promotion on website entries and social media sites (collectively “Publications”), my name, likeness, image, photograph, voice, and video as related to and in conjunction with my attendance of and/or
participation in the Retreat or any activities associated therewith (collectively “Materials”).

2. I irrevocably and permanently WAIVE ANY RIGHT TO ROYALTIES OR OTHER COMPENSATION arising from or related to the use of the Materials. I knowingly and voluntarily waive any and all rights I may have under any state law, that provides, as follows in substance: A general release does not extend to claims which the creditor does not know or suspect to exist in the creditor’s favor at the time of executing the release, which if known by the creditor must have materially affected the creditor’s settlement with the debtor.

3. I irrevocably and permanently authorize the Released Parties to edit, alter, copy, exhibit, publish, and/or distribute all Materials for any and all purposes, including the purpose of promoting Petra Rising LLC, the Retreat, and/or related activities in print, brochures, advertisements, films, videos and on broadcast presentations of any sort.

4. I irrevocably and permanently WAIVE FINAL RIGHT OF APPROVAL pending publication of any Materials.

5. I hereby warrant, represent and agree to INDEMNIFY, DEFEND, HOLD HARMLESS, RELEASE, and FOREVER DISCHARGE the Released Parties from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or other persons acting on my behalf or on behalf of my estate which may have or may have by reason of this authorization for right of publicity, copyright infringement, defamation, or any other cause of action arising out of the use, exploitation, reproduction, adaptation, distribution, broadcast, performance, or display of the Materials.

6. I hereby acknowledge and agree that the Released Parties will be the exclusive owner of all rights, title, and interest, including copyrights, in any and all Materials, whether or not published.

By signing this document, I acknowledge that I have carefully read this Photographic Release Agreement and fully understand its contents. I have signed this Photographic Release Agreement knowingly, voluntarily, and of my own free will. I further understand that if any part of this document is determined to be unenforceable, all other parts shall continue to be given their full effect.


I agree that any dispute regarding this Release Agreement shall be governed by and interpreted in all respects in accordance with the laws of the United States of America and the State of Texas. The venue for any dispute shall be in the County of Hays.


I understand that this is the complete Photographic Release Agreement. In entering into this Photographic Release Agreement, I am not relying upon any oral or written representations made by the Released Parties other than what is set forth in this Photographic Release Agreement.

7. General Provisions: The Company may modify the terms of this TOU at any time. All modifications shall be posted on the Company’s website and participants shall be notified via email. If any provision of this TOU is held invalid or unenforceable, the remainder of this TOU will remain in full force and the invalid or unenforceable provision will be replaced by a valid or enforceable provision.


This is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This TOU supersedes all prior written and oral representations.

By clicking on the box when signing up for the Retreat, you are providing the electronic equivalent of your signature and assert that you have read, understood and agreed to this entire document. If you do not agree with these TOU, do not purchase this event.
